Unconscionability is present in such relationship where there are two parties, in which one is the dominating one and the other is the weaker one. As a result of this, unconscionability is often mixed with the vitiating factors like undue influence and duress. Under the contract law, unconscionability a llows the dominating party to take advantage of the weaker party due to the special disability held by the weaker party. Some of the special disabilities include age, less education, illiteracy and the combination of these. This special disability allows for the weaker party to be oppressed and to be dealt in a harsh manner (Clarke, 2018a). This discussion is focused on highlighting the different facets of unconscionability particularly in context of the common law and the statutory law of the nation. Particularly in context of Australia, the leading example of unconscionability is the case of Commercial Bank of Australia v Amadio(1983) 151 CLR 447. The reason for the significance of this case is not just because this case involved unconscionability but also because this case became an important lesson for the banks in the nation, to not be indulged in such conduct, which could prove costly for them. This case had a mortgage being signed for securing the loan for the son of A by them. A were never informed of what was going on or even about the details of this mortgage. This would mean that she would not have a home to live in, and ultimately she would end her life. However, most of this was false. Due to the emotional pressure exerted by Louth on Diprose, he agreed to purchase the house for Louth; and due to instance of Louth, the name of Louth was put on the documents. After some years lapsed, the relation between the two was damaged and ended. Diprose then asked Louth to transfer the home which he had brought for her in his name, as he had made the payment for the house. However, Louth denied to do so and this led to Diprose initiating a suit against her. When the matter was presented before the court, they stated that Diprose had to be given the entitlement to the land for the reasons of him having brought the same and given to Louth due to her use of unconscionability. The succeeding appeals to this matter were also declined b the court due to the misuse of the emotional state of Diprose by Louth (Clarke, 2018c). Till now, the unconscionability was discussed in context of the common law, but now the discussion would move on to the statutory law of Australia, which provides the provisions against unconscionability. The Australian Consumer Law (ACL), which is covered under schedule 2 of the Competition and Consumer Act, 2010 presents the provisions against unconscionability. Section 21 of the ACL places a restriction on the ones indulged in trade and commerce, from indulging in unconscionable conduct, when the goods and services are supplied in business transactions (Austlii, 2018). When it comes to unconscionability, the situations surrounding the transaction is what decides its presence or absence (Coorey, 2015). An example of this can be cited in the individual not being provided with sufficient time for going through a contract to be signed by them. Under section 22 of the ACL, the various factors which have to be considered by the court for holding the presence of unconscionability. Where the presence of unconscionability is found in the business, the penalty on individuals is imposed to a maximum of $220,000 and this value for the body corporate stands at $1.1 million owing to the undertaken unconscionability (Corones, 2012). A seal can provide five days worth of food. If the bears are starving they eat the whole seal; otherwise, they just eat the blubber and entrails for protein (National Parks Service). The bears live in Canada or above. They rarely go below Canada since it is too warm there. The giant bears have thick white fur, which helps the bear survive the cold, and it has a thick layer of blubber all around its body where it stores up food when needed. They can go with out food for 2 weeks if necessary (Larsen 7). Their fur is what helps retain the heat inside their bodies. The fur looks white but it is actually clear colored. The sun shines through the clear fur to the bear's black skin, which absorbs the heat and retains it. Actually it does such a good job that the bears have to jump in icy water, and even roll in the snow to cool off. Fredtjoj Nansen gives this description of the polar bear, ?Elegant body, big neck, small head, and short ears give it a ferocious look? (6). When its time for the bears to reproduce, the male approaches the female. The males have many mates in their lifetime. When the females are pregnant, they dig a den in which they stay until after pregnancy for a while with the bears can survive the cold. The mothers live off their body fat to make milk and live since they cannot leave the den (WWF 2). The mother actually spends a period of three months in the den while pregnant. The cubs, after birth, spend three years before they go out on their own into the ice world. Males do not do anything with cubs only mothers do (National Park Service). Polar Bears stay in certain places in the Arctic Circle. They live near coasts since their main food is seals. They usually migrate south in the winter and back in the summer (WWF 1). Five nations, the United States, Canada, Denmark, Norway, and the Soviet Union, got together and decided that they were going to find out the status on how many bears are still left. What they found was that the once ?invincible bear? would go extinct in a matter of ten years if nothing was done to protect them (Larsen 5). The nations thought the bears moved around the North Pole, but they generally stay in the same area during their life. The Soviets had protected their own polar bears since 1956. They believed they had 5,000 to 10,000 bears, though didn't know thousands of them were being hunted and killed each winter. Taliban Decrees and Prohibitions Against Women Immediately on taking over cities and communities in Afghanistan, the Taliban imposed its law, based on an interpretation of Sharia  or Islamic  law that was stricter than in any part of the Islamic world. The interpretation is at wide variance from that of most Islamic scholars. With very minimal changes, what follows are the Taliban rules, decrees, and prohibitions as posted in Kabul and elsewhere in Afghanistan beginning in November and December 1996, and as translated from Dari by Western non-governmental agencies. The grammar and syntax ​follows the original. Those rules still prevail wherever the Taliban is in control – in vast parts of Afghanistan or in Pakistans Federally Administered Tribal Areas. If you go outside the house you should not be like women who used to go with fashionable clothes wearing much cosmetics and appearing in front of every men before the coming of Islam.Islam as a rescuing religion has determined specific dignity for women, Islam has valuable instructions for women. Women should not create such opportunity to attract the attention of useless people who will not look at them with a good eye. Women have the responsibility as a teacher or coordinator for her family. Husband, brother, father have the responsibility for providing the family with the necessary life requirements (food, clothes etc). In case women are required to go outside the residence for the purposes of education, social needs or social services they should cover themselves in accordance with Islamic Sharia regulation. If women are going outside with fashionable, ornamental, tight and charming clothes to show themselves, they will be cursed by the Islamic Sharia and should never expect to go to heaven.All family elders and every Muslim have responsibility in this respect. We request all family elders to keep tight control over their families and avoid these social problems. Otherwise these women will be threatened, investigated and severely punished as well as the family elders by the forces of the Religious Police (Munkrat).The Religious Police have the responsibility and duty to struggle against these social problems and will continue their effort until evil is finished. To prevent keeping pigeons and playing with birds. Within ten days this habit/hobby should stop. After ten days this should be monitored and the pigeons and any other playing birds should be killed.5. To prevent kite-flying. The kite shops in the city should be abolished.6. To prevent idolatry. In vehicles, shops, hotels, room and any other places, pictures and portraits should be abolished. The monitors should tear up all pictures in the above places.7. To prevent gambling. In collaboration with the security police the main centers should be found and the gamblers imprisoned for one month.8. To eradicate the use of narcotics. Addicts should be imprisoned and investigation made to find the supplier and the shop. The shop should be locked and the owner and user should be imprisoned and punished.9. To prevent the British and American hairstyle. People with long hair should be arrested and taken to the Religious Police department to shave their hair. The criminal has to pay the barber.10. To prevent interest on loans, charge on changing small denomination notes and charge on money orders. All money exchangers should be informed that the above three types of exchanging the money should be prohibited. In case of violation criminals will be imprisoned for a long time.11. To prevent washing cloth by young ladies along the water streams in the city. Violator ladies should be picked up with respectful Islamic manner, taken to their houses and their husbands severely punished.12. To prevent music and dances in wedding parties. H.H Holmes: Serial Killer Eloisa Luzuriaga Herman Webster Mudgett better known as H. H Holmes was one of the first serial killers in America. He was born on May 16, 1861 in Gilmanton, New Hampshire, to a wealthy family (H.H. Holmes). As a young boy Holmes was constantly bullied. His bullies found out about his fear of the local doctors office so they took him there and forced him to touch a human skeleton. Instead of getting scared he was fascinated by the experience. Since that day his interest in human anatomy was born. Holmes became obsessed with death, he started dissecting dogs, cats, or any homeless animal he could find. His experiments with animals were just a rehearsal for what was yet to come. On July 8, 1878, New Hampshire, Holmes married Clara A. Lovering of Alton. She was the daughter of a rich local farmer. They had a son named Robert Lovering Mudgett, he was born on February 3, 1880, in Loudon, New Hampshire. His marriage with Clara had failed apart. One year later he left New Hampshire to attend the University of Michigan Medical School. It was there that he gave himself his own nickname Dr. Henry Howard Holmes. He stole corpses from medical laboratories. He disfigured the corpses and planted them where they would be found as accidents. He collected the insurance money from policies of the corpses and then he would claim they were the relatives of H.H. Holmes. He graduated from Medical School in 1884 (Herman Webster Mudgett). After graduating he moved to Chicago. There he was involved in some businesses like real state and promotional deals. He married Myrta Z. Belknap on January 28, 1887, in Minneapolis, Minnesota. Although he was still married to Clara Lovering this made him a bigamist. He had a daughter with Myrta named Lucy Theodore Holmes, born 4 July 1889 in Englewood, Illinois. Myrtas father was a wealthy businessman, a man Holmes had unsuccessfully tried to kill. The family of three lived in the Chicago suburb of Wilmette. Holmes started working at a pharmacy. The owner was Dr. E.S. Holton who suffered from cancer and his wife was in charge of the pharmacy. She was an old woman that needed an assistant. Holmes got the job and manipulated her into selling him the pharmacy. They made an agreement that she could still live in the upstairs apartment even after Holton died. When Holton died, Holmes murdered Mrs. Holton. She became Holmes first known killing. He told people that Mrs. Holton moved to Cal ifornia (H.H. Holmes Serial Killer Part 2 of 4). Holmes bought a lot across from the pharmacy, where he built his three story building that was later nicknamed Murder Castle. This hotel was designed by Holmes and was opened in 1893 for the Worlds Columbian Exposition. His sole purpose for the hotel was to lure, trap, dismember, and murder guests. During the construction of the hotel he often fired builders as they became suspicious about the design of the hotel. From the outside the building looked like a Medieval fortress, complete with turret. The first floor had Holmes relocated drugstore and various shops like a jeweler. The other two upper floors contained his office as well as a maze of trap doors, secret compartments, and hidden stairways. The most disturbing room was the basement which was equipped with medical tools, poisons, torture devices, and acid filled pits. From his bedroom Holmes controlled gas pipes that led up to the basement to specific rooms so he could put his victims unconscious. For a period of three years, Holmes picked female victims from among his hotel guests, employees, and lovers to torture and kill them. Some were locked in soundproof bedrooms shaped with gas lines that allowed him to asphyxiate them at any time. Others were locked in a vast bank vault near his office so he could sit and enjoy the show as they screamed, panicked, and suffocated due to the soundproof vault. The bodies of the victims went by a secret chute to the basement, where some were dissected, stripped of flesh, crafted into skeleton models, and then sold to medical schools. He also placed the bodies in lime pits and cremated them for destruction. Holmes performed hundreds of illegal abortions and some of his patients died during the procedure. He was able to easily sell skeletons and organs because of the connections he made through medical school (A Double Dose of Macabre). Following the Worlds fair, with the fall of the economy and with creditors closing in, Holmes left Chicago. He moved to Fort Worth, Texas where he inherited property from two sisters, he had promised one of them marriage but he murdered both of them. He planned to construct another castle but he abandoned the idea because he found the law enforcement climate in Texas inhospitable. In July 1894, Holmes was arrested for the first time, for a horse swindle that ended in St. Louis. While in jail he met a convicted train robber named Marion Hedgepeth. Later he was bailed out of jail. Holmes had a plan to bilk an insurance company out of $20,000 by taking out a policy on himself and then faking his death. He promised Marion a $500 commission in exchange of a lawyer he could trust. He was led to Colonel Jeptha Howe who found Holmes plan brilliant. But his plan failed when the insurance company became suspicious and refused to pay. He made another plan with his sales associate Pitezel. Pitezel agreed to fake his own death so that his wife could collect the $10,000 policy, which she had to split with Holmes and Howe. The plan would take place in Philadelphia and Pitezel would set himself up as an inventor, named B.F. Perry, and then be killed and disfigured in a lab explosion. Holmes had to find a cadaver to play the role of Pitezel. But Holmes killed Pitezel and colle cted the policy of his corpse. He then manipulated Pitezels wife into allowing three of her five children to stay in his custody. Only the oldest daughter and baby remained with Mrs. Pitezel. He traveled through the northern U.S. and into Canada with the rest of the children whose names were Alice, Nellie, and Howard. He lied to Mrs. Pitezel about her husbands death and her children whereabouts. A detective from Philadelphia had tracked Holmes and found the decomposed bodies of the two Pitezel girls in Toronto. He then followed Holmes to Indianapolis where Holmes had rented a cottage. He was reported to have visited a drugstore where he purchased the drugs that he used to kill Howard, and a repair shop to sharpen the knives he used to chop the body before he burned it. Howards teeth and bits of bone were discovered in the cottages chimney (Herman Webster Mudgett). In 1894 the police were tipped off by Marion because Holmes refused to pay him the $500 that he promised him. Holmes was finally arrested in Boston on November 17, 1894. The police investigated the castle and uncovered Holmes methods of committing murders and the disposing of his corpses. In August 19, 1895, a fire of mysterious origin consumed the castle. The site now serves as a U.S. Post office building. While Holmes was in prison in Philadelphia the Chicago police began to unravel what really happened to Pitezel and his three missing children. Holmes was put on trial for the murder of Pitezel and he confessed to 27 murders in Chicago. He was paid $7,500 by the Hearst Papers in exchange for his confession. One of Holmes most famous quotes published in the North American Philadelphia on April 11, 1896, was I was born with the devil in me. I could not help the fact that I was a murderer, no more than the poet can help the inspiration to sing I was born with the Evil One standing as my sponsor beside the bed where I was ushered into the world, and he has been with me since (Mysterious Chicago Tours). On May 7, 1896 Holmes was hanged at Moyamensing Prison. Before his death Holmes remained calm and affable. He showed few signs of fear, depression, or anxiety. His neck didnt snap immediately, he died slowly, strangling for fifteen minutes before being pronounced dead twenty minutes after the trap was sprung. He requested that he be buried in concrete and that no one would be allowed to dissect his body. His request was granted. On March 7, 1914, a story in the Chicago Tribune reported the death of the caretaker of the castle, his name was Pat Quinlan. He committed suicide by taking strychnine and the newspaper reported that his death meant the mysteries of the castle would remain unexplained. The Crash – Creative Writing

The multi coloured sky changes rapidly into the dark lonely night but drops of diamond shining stars brighten it. You're all alone in an isolated office. Working another tiring day of over time. Your watering eyes begin to feel weary. You look across at the busy view of the noisy city. The ringing sound of the modern clock catches your attention. The silver metallic hand points ar 10pm. You realise how long you have been working but in front of you stands a mound of urgent paper work. Just having a glimpse brings a thumping pain in your head. You decide to return home as it is getting late. A sudden strike of rumbling thunder makes you spring slightly into the cold air. You stare towards the reflective windows, but all you see is a flash of dazzling white light. The empty office lights starts to flicker. You walk out of the cluttered office at a fast pace. You get an intense feeling. You quickly move yourself outside into the artic air. You take a long deep breath. You can feel the frost biting into your breathing lungs. You shiver bitterly. You get into your frozen car. The freezing journey seems to be everlasting. You feel your dark eyes slowly closing but you try your best to fight away the sleep. Ten long minutes passes yet you drive steadily, out of the darkness shines a blinding light. You hear the loud sound of another car. Your vision turns black. You're scared and lonely. You question yourself. Am I dead? You panic. A dear visitor whispers into your ear. You suddenly open your tired eyes. A pair of round brown eyes stares at you. You scream. You recognise the familiar faces surrounding you, it's you irreplaceable family. The feeling of unknown strangers disappears. You begin to think what had happened and search for the answer to a family gathering. You discover the answer. They are visiting because they are deeply concerned about your unstable condition as you were unluckily caught up in a terrible accident. You're surprised you survived. The boring months pass. It seems like they are extended. You are finally all healed and returning to your cosy home. You miss you comfy bed. The beautiful morning arrives. You happily get ready for hours of work. You get into your pastel blue car. You rush past the quiet area where the terrorising accident occurred. You arrive promptly at the office. Whilst you're in the cramped lift, pain takes over your head. Frightening images reminisce in front of you. The night of the accident. But there's an unfamiliar image. You see yourself being chased then falling off the top of a sky scrapping building. The pain gradually fades. The tiring day depart, the night covers the sun rays like a blanket. You stay over time once again. You find yourself enclose in the dark with only the spot of luminous light from your desk. There seems to be another power cut. You recognise the situation you are in. it's just like the night of the accident and what you saw during the short period in the lift. Your pounding heart grows louder each second. You hear the breath of a stranger. You look around. All you see is a vague silhouette. You some how manage to escape out of the office. You reflect back on the night of the crash.
